fa جایگاه دیوان عدالت اداری در حقوق اداری ایران تخصصي Special كاربردي Applicable دیوان عدالت اداری از ارکان قوه قضائیه  برای رسیدگی به شکایات و دعاوی اداری عهده دار نظارت و مطابقت آیین نامه ها و تصمیمات و اقدامات اداری قوه مجریه با قوانین وهمچنین مرجع حل و اختلاف بین افراد و دولت می باشد. مطابق اصل (173) قانون اساسی دیوان عدالت اداری  به منظور رسیدگی به شکایات و تظلمات و اعتراضات مردم نسبت به مأمورین یا واحدها یا آئین نامه های دولتی و احقاق حقوق آن ها تشکیل گردید، جایگاه آن هم درقانون قبلی و هم قانون بعدی دیوان عدالت اداری توسط قانونگذار مشخص گردیده است و با توجه به بعد نظارتی، اختیارات آن در مورد مقررات دولتی سایر قوا و مراجع قدرت و همچنین مواردی نظیر نقض اصل برابری و منع تبعیض درجایگاه حقوق اداری اشاره داشته و هدف این مقاله جایگاه دیوان عدالت اداری در حقوق اداری ایران بوده که مورد بررسی قرار می­دهد. Administrative Justice Court is one of the organs of the Judiciary which hears the administrative complaints and lawsuits, and supervises the conformity of bylaws, decisions and actions of the government with law. Furthermore, it is the source for settlement of disputes arise between people and the government. According to principle No. 173 of Constitution, Administrative Justice Court is established in order to hear the complaints and objections of the people regarding the governments’ agents, units or bylaws and recover their rights. The role of the Administrative Justice Court is designated by the legislation authority in previous and current law. Concerning the supervision aspect, Administrative Justice Court has authorities in governmental regulations of other powers and authorities, as well as the cases of violation of the principle of equality and discrimination in administrative law.
