fa ساختار حقوقی «صندوق توسعه ملی» و بررسی ترکیب اعضای هیأت امناء آن تخصصي Special كاربردي Applicable <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:IRANyekan;"><span style="background: white;"><span style="direction: rtl;"><span style="unicode-bidi: embed;"><span style="color: black;"><span lang="FA"><span style="color:black"><span style="text-decoration:none">صندوق توسعه ملی</span></span></span></span><span lang="FA"><span style="color:black"> پس از تجربه ناموفق حساب ذخیره ارزی، بر اساس ماده (۸۴) قانون</span></span>&nbsp;برنامه پنجم توسعه<span lang="FA"><span style="color:black">&nbsp;ماده (16) قانون احکام دائمی برنامه&shy;‌های کشور&nbsp;تأسیس گردید. با توجه به عملکرد ضعیف حساب ذخیره ارزی و تجربه شکست آن به دلیل فقدان توان مقابله با تصمیمات مراجع بالادستی، تأسیس صندوق توسعه ملی با شخصیت حقوقی مستقل از دولت ضروری بوده و بر همین اساس مطابق اساسنامه صندوق، مرجع تصمیم&shy;‌گیری در این نهاد به نحوی تعیین شده که استقلال صندوق در اتخاذ سیاست‌&shy;ها و اجرای آنها محقق شود و امکان مقابله با فشار دولت و نیروهای سیاسی وجود داشته باشد. لیکن عملاً در بررسی ماده (16) قانون احکام دائمی برنامه&shy;‌های توسعه کشور (اساسنامه صندوق) مشخص گردید؛ ترکیب اعضای هیأت امناء صندوق به نحوی تعیین شده که از 9 نفر عضو صاحب رأی این هیأت، 6 نفر از اعضای دولت هستند و 2 نفر از اعضای قوه مقننه و یک نفر از قوه قضاییه می‌&shy;باشند. رئیس اتاق تعاون و رئیس اتاق بازرگانی به عنوان نمایندگان بخش غیردولتی، بدون حق رأی در این هیأت حضور دارند. طبق تبصره (2) بند (پ) اساسنامه صندوق، جلسات هیأت امناء با حداقل دو سوم اعضاء صاحب رأی (6 نفر) رسمیت یافته و با حداقل 5 رأی اتخاذ تصمیم می&shy;‌گردد؛ لذا ملاحظه می‌&shy;شود در صورت حضور صرف 6 نفر اعضای قوه مجریه در جلسه، جلسات رسمیت یافته و امکان اخذ تصمیم نیز وجود دارد و نیازی به حضور و آرای نمایندگان مجلس و قوه قضائیه نخواهد بود؛ بنابراین، در جهت رسیدن به اهداف و تحقق رسالت صندوق توسعه ملی به نظر می&shy;‌رسد تجدیدنظر در اساسنامه صندوق و به ویژه ترکیب اعضاء هیأت امناء ضروری است.</span><span style="line-height:115%"></span></span></span></span></span></span></span><br> <span style="font-family:IRANyekan;"><span style="line-height:2;"><span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span dir="LTR" style="font-size:11.0pt"><span style="font-family:"b mitraTimes New Roman",serif"></span></span></span></span></span></span></span></div> <div style="text-align: justify;"><b><span style="font-size:9.0pt"><span style="line-height:115%"><span inherit="" style="font-family:"><span style="color:#202124">The National Development Fund was established based on Article (84) of the Fifth Development Plan Law (Article (16) of the Law on Permanent Provisions of the Country&#39;s Programs - Fund Statutes) after the unsuccessful experience of the foreign exchange reserve account. According to note (2) of paragraph (c) of the fund&#39;s statutes, the meetings of the board of trustees are formalized with at least two-thirds of the voting members (6 people) and the decision is taken with at least 5 votes.
