fa واکاوی صلاحیت شورای عالی فنی در انتظام بخشی پیمانهای دولتی با نگاهی به ماده (53) شرائط عمومی پیمان نشریه 4311 سازمان برنامه و بودجه تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:IRANyekan;"><span style="line-height:150%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span lang="FA"><span style="line-height:150%"><span b="" mitra="">&nbsp;شورای عالی فنی مستقر در سازمان برنامه و بودجه، پنج صلاحیت منحصر به فرد در رابطه با پیمان‌های دولتی بر عهده دارد. این مرجع به نمایندگی از دولت با بررسی و تصویب قیمت‌های پایه، تصویب قیمت کارهای خاص که قیمت پایه ندارند، تجدید نظر در نرخ پیمان‌ها، ارائه طریق در خصوص موضوعاتی که در قرارداد برای آنها راه حلی ارائه نشده و همچنین داوری در اختلافات حادث شده بین پیمانکار و دولت، چارچوب قراردادهای دولتی و نتایج احتمالی ناشی از آنها را دستخوش تغییر می‌کند. صلاحیت اخیر در ماده (53) شرائط عمومی پیمان به این مرجع اعطا شده است. در این مقاله با تمرکز بر مفهوم عام و خاص داوری دولتی و توجه به رویه این مرجع کوشش خواهد شد. ضمن آسیب‌شناسی عملکرد شورای مذکور با لحاظ صلاحیت‌های سازمان برنامه و بودجه در سیاستگذاری مالی کشور، نقش شورای عالی فنی در انتظام بخشی پیمان های دولتی در پرتو صلاحیت داوری در اختلافات پیمانکاری واکاوی گردد.</span></span></span></span></span></span></span><br> &nbsp;</span></div> <span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Calibri,sans-serif">Abstract: The High Technical Council, located in the Planning and Budget Organization, has five unique competencies in relation to government contracts. This authority, representing the government, changes the framework of government contracts and their possible outcomes by reviewing and approving base prices, approving prices for specific works that do not have a base price, revising contract rates, providing guidance on issues for which no solution is provided in the contract, and also arbitrating in disputes that arise between the contractor and the government. The latter competency is granted to this authority in Article (53) of the General Conditions of Contract.
