fa رسیدگی به شکایات از مناقصات در نظام حقوقی ایران تخصصي Special پژوهشي Research یکی از عوامل مؤثر بر سلامت برگزاری مناقصات، وجود سازوکار نظارتی است که براساس قوانین و مقررات شکل گرفته باشد تا در صورت ضرورت بتواند، با مداخله به موقع، فرآیند برگزاری مناقصه را از انحراف بازدارد. سازوکار مزبور نه تنها باید شامل اعمال نظارت های مستمر و مورد پیگرد قراردادن تخلفات و جرائم عمومی باشد، بلکه همچنین باید قادر باشد تا فرآیند مناقصه ای را که مطابق با قوانین و مقررات نبوده است را به مسیر صحیح هدایت نماید. کارکرد دیگر نهادهای نظارتی که همزمان به شکایات مناقصه گران از فرآیند برگزاری مناقصه رسیدگی می کند، برخورداری از خصیصه پیشگیرانه نسبت به ارتکاب جرم و تخلف است. بنابه همین دلایل، وجود نهاد ناظر بر عملکرد مناقصه گزار و رسیدگی کننده شکایات مناقصه گران، یکی از ارکان اساسی حقوق مناقصات را شکل می دهد. در این راستا قانون برگزاری مناقصات ایران با تأسیس نهاد &laquo;هیأت رسیدگی به شکایات&raquo;، ضمن به رسمیت شناختن این حق برای مناقصه گران، به بیان وظایف و اختیارات نهاد مزبور و نحوه رسیدگی به شکایات در زمینه برگزاری مناقصات، پرداخته است که میزان انطباق اصول بکار رفته در توصیف آن، با اصول رسیدگی منصفانه، موضوع این تحقیق می باشد.<br> &nbsp; One of the factors affecting the health of bidding is the existence of a regulatory mechanism that is based on rules and regulations, so that it can, if necessary, delay the bidding process with timely intervention. The mechanism should not only include the implementation of continuous monitoring and prosecution of offenses and public crimes, but also should be able to direct the process of a tender that is not in accordance with the laws and regulations to the correct direction. Another function of the supervisory authorities that simultaneously deals with the tenderers&#39; complaints of the bidding process is to have a preventive character in relation to the commission of the offense and the crime. For these reasons, the existence of reviewing body of tenderers&#39; complaints forms one of the fundamental pillars of the laws of the tenders.
