The Position of Administrative Justice Court in Iran’s Administrative Law

Administrative Justice Court is one of the organs of the Judiciary which hears the administrative complaints and lawsuits, and supervises the conformity of bylaws, decisions and actions of the government with law. Furthermore, it is the source for settlement of disputes arise between people and the government. According to principle No. 173 of Constitution, Administrative Justice Court is established in order to hear the complaints and objections of the people regarding the governments’ agents, units or bylaws and recover their rights. The role of the Administrative Justice Court is designated by the legislation authority in previous and current law. Concerning the supervision aspect, Administrative Justice Court has authorities in governmental regulations of other powers and authorities, as well as the cases of violation of the principle of equality and discrimination in administrative law. This article tries to study the position of Administrative Justice Court in Iran’s Administrative Law. |
