One of the factors affecting the health of bidding is the existence of a regulatory mechanism that is based on rules and regulations, so that it can, if necessary, delay the bidding process with timely intervention. The mechanism should not only include the implementation of continuous monitoring and prosecution of offenses and public crimes, but also should be able to direct the process of a tender that is not in accordance with the laws and regulations to the correct direction. Another function of the supervisory authorities that simultaneously deals with the tenderers' complaints of the bidding process is to have a preventive character in relation to the commission of the offense and the crime. For these reasons, the existence of reviewing body of tenderers' complaints forms one of the fundamental pillars of the laws of the tenders. In this regard, the "Law on Conducting Tenders" in Iran by establishing the "Complaints Board", while recognizing this right to the tenderers, expresses the duties and authority of the said institution and the manner in which complaints are handled in respect of tenders, so the degree of conformity of the principles is applied to describe it in comparing with the principles of a fair treatment in challenge process, is the purpose of this research.
