Abstract: The High Technical Council, located in the Planning and Budget Organization, has five unique competencies in relation to government contracts. This authority, representing the government, changes the framework of government contracts and their possible outcomes by reviewing and approving base prices, approving prices for specific works that do not have a base price, revising contract rates, providing guidance on issues for which no solution is provided in the contract, and also arbitrating in disputes that arise between the contractor and the government. The latter competency is granted to this authority in Article (53) of the General Conditions of Contract. In this article, focusing on the general and specific concept of government arbitration and paying attention to the procedure of this authority, an attempt will be made to analyze the role of the High Technical Council in regulating government contracts in light of the arbitrating competence in contracting disputes.
